إن نشر حقوق الإنسان والدفاع عنها منوط دائماً بعمل الأمم المتحدة لأنها منظمة عالمية أخذت على عاتقها
هذه المسؤوليات. مع هذا فإنه بسبب الإنتهاكات الإسرائيلية المستمرة لحقوق الإنسان في فلسطين ظهرت وجهات نظر
تشكك في فعالية هذه المنظمة لذلك فإن هذه الأطروحة جاءت لتتفحص فعالية الأمم المتحدة في منع انتهاكات حقوق
الانسان في فلسطين وذلك بالتركيز على فعاليتها في منع بناء المستوطنات غير القانونية في الأراضي الفلسطينية
المحتلة التي تؤثر بشكل كبير على حقوق الفلسطينيين. تقدم هذه الأطروحة تفسيراً مفصلاً لنشوء المستوطنات
وأهدافها الاستراتيجية. فضلاً عن تركيزها على آثارالمستوطنات المتعددة على حقوق الإنسان للفلسطيين بما في ذلك
حق الحياة، والأمن، وحق تقرير المصير، وحرية الحركة والتنقل، وحق الماء، وحق الملكية، والحق في مستوى
معيشي كافٍ. إضافة إلى ذلك تبرز الرسالة عدم مشروعية بناء المستوطنات بناءاً على القانون الدولي وقرارات ألامم
المتحدة .تستخدم هذه الأطروحة المنهج الوصفي التحليلي لتحليل دورالأجهزة هيئة الأمم المتحدة في تعاملها مع قضية
المستوطنات منذ عام 1967 وحتى عام 2018. توصلت الأطروحة الى نتيجة مفادها أن الأمم المتحدة لم تكن على
قدر كاف من الفعالية لإيقاف بناء المستوطنات وذلك بسبب التحديات التالية: إصرار اسرائيل على مشروعية بناء
المستوطنات، فشل مجلس الأمن في استخدام الأجراءات البديلة بعيدا عن الإدانات التي اثبتت عدم فاعليتها في حل
المشكلة. وفي الختام تقدم الأطروحة بعض التوصيات لزيادة فاعلية الأمم المتحدة فيما يتعلق بإيقاف بناء المستوطنات.
The promotion and the protection of human rights are always linked to the UN work since it is an international organization that undertakes such responsibilities. However, due to Israeli ongoing human rights violations in Palestine, views had been expressed that this organization may not be effective. Therefore, this thesis has set out to examine the effectiveness of the UN in preventing human rights violations in Palestine by focusing on the effectiveness of the UN in preventing the construction of illegal settlements in OPTs since 1967 up to 2018.The thesis provides a detailed account of the emergence of settlements and their strategic purposes. Most importantly, it focuses on the settlements’ severe impacts on the human right of Palestinians such as the right to life and security of person, the right to self-determination, freedom of movement, the right to water, the right to private property, the right to be treated equally, and the right to an adequate standard of living. Moreover, it highlights the illegality of the settlements according to international law and UN related resolutions. It employs the descriptive analysis approach to analyze the role of UN principal bodies in dealing with the question of settlements since 1967 to 2018. It concludes that the UN has been ineffective to prevent the construction of the settlements due to the following challenges: The Israeli determination to legitimize the construction of settlements, the UNSC failure to use an alternative measure apart from condemnations which have been proved to be invalid to solve the problem. Finally, this thesis offers some recommendations to increase the effectiveness of the UN regarding the subject matter.
