كشفت التطورات التكنولوجية التي جرت على مدى العقود القليلة الماضية عن مخاوف جديدة تتعلق بخصوصية الفرد. وقد نتج عن الأبحاث الأكاديمية المرتبطة بالخصوصية فيض من المفاهيم التي غدت عقبة أمام حماية الحق في الخصوصية. تهدف هذه الأطروحة إلى فهم مسألة الخصوصية من وجهة نظر عدة تخصصات أكاديمية والذي من شأنه تأطير تقييمٍ نقديّ للحق في الخصوصية على النحو الذي يضمنه نظام حقوق الإنسان الأوروبي في العصر الرقمي. وسيوفر هذا التقييم المعلومات المطلوبة من الناحية القانونية على المستويات الوطنية والإقليمية والدولية بهدف تحسين حماية الحق في الخصوصية في ضوء التطورات التكنولوجية المتسارعة.
تتخذ هذه الدراسة منهجًا متعدد الأساليب للبحث، بما في ذلك، على سبيل المثال لا الحصر، الأساليب النوعية والوصفية والتحليلية، والتي تعتمد على جمع البيانات الثانوية وتحليلها وتفسيرها. وبشكل عام، تخلص الأطروحة إلى أن الفهم النظري للخصوصية قاصر ويقف عائقًا أمام الحماية القانونية المناسبة للحق في الخصوصية. يقف هذا الفهم القاصر عائقًا أمام السلطات التشريعية مانعًا إياها عن صياغة القوانين التي تحمي الفرد من الانتهاكات غير المرغوب فيها وغير المصرح بها للحق في الخصوصية. بالإضافة إلى ذلك، تتطور التكنولوجيا بشكل أسرع بكثير من التشريعات الوطنية والدولية مما يترك الأفراد عرضة لانتهاكات الخصوصية التي تسهلها التكنولوجيا.
In an increasingly digitized world, technology disruption and advancements over the past few decades have unveiled new concerns for individual privacy. Extensive research on privacy has only produced a conceptual disarray, technically hindering the protection of the right to privacy. This thesis aims to cut across various academic disciplines to fill the gap in knowledge through understanding privacy both as a concept and a right in the Information Age. A multi-disciplinary understanding of privacy serves to shape a critical assessment of the right to privacy as guaranteed by the European human rights system in the digital age. An assessment of the right to privacy is intended to inform national, regional and international legal jurisprudence to better protect the right to privacy in light of accelerated technological advancements.
This study takes a multi-method approach to research, including, but not limited to, qualitative, descriptive, and analytical methods, which are based on the collection, analysis, and interpretation of secondary data. Overall, the thesis concludes that the true threat to privacy is the inadequate conceptual understanding of privacy. This lack of understanding hinders legislative authorities from drafting laws that protect the individual from unwanted and unauthorized infringements on the right to privacy. Additionally, disruptive technology evolves much faster than national and international legislation leaving individuals vulnerable to technology-facilitated privacy violations.
