تتناول هذه الدراسة موضوع(القواعد الفقهية المتعلقة بالتقاضي امام المحاكم الشرعية الأردنية).
يعتبر علم القواعد الفقهية من العلوم الشرعية المهمة جدا لكل من يعمل في سلك القضاء الشرعي ،ذلك لانها توصل الى معرفة الاحكام على الوجه الذي يريده الله سبحانه وتعالى ،ولذلك قام العلماء القدماء بتدوين هذه القواعد بعبعرة فقهية مختصرة يسهل على طالب العلم الوصول اليها وكذلك إمكانية التطبيق عليها.
ولقد ركزت هذه الدراسة على اجتهادات المحاكم الشرعية الأردنية من خلال القرارات الصادره عنها ،وتتبع القرارات الصادره عن المحاكم الشرعية ،مع استخراج ما بني منها على القواعد الفقهية ،متبعا تلك القواعد بامثلة تطبيقية توضيحية،ومبينا عمل المحاكم الشرعية الأردنية واجراءاتها اثناء تداول تلك الاحكام،واضافة الى الاثار المترتبة على اجتهادات المحاكم الشرعية المبني على القواعد الفقهية.
وجاءت هذه الدراسة في ستة فصول الأول تمهيدي احتوى على التعريف بمصطلحات الدراسةواهمية القواعد الفقهية ومصادرها ونشاة المحاكم الشرعية ودرجات المحاكم الشرعية،والأول القواعد الفقهية المتعلقة بالدعوى،والثاني القواعد الفقهية المتعلقة بالقاضي،والثالث القواعد الفقهية المتعلقة بالحكم القضائي،والرابع القواعد الفقهية المتعلقة بالحكم القضائي،والخامس القواعد الفقهية المتعلقة بأطراف الدعوى.
واسال الله التوفيق والسداد وان يكون هذا العمل في ميزان حسناتي ،يوم لا ينفع مال ولا بنون،الا من اتى الله بقلب سليم.
jurisprudential rules concerning litigation before the Jordanian Shari'a courts.
The jurisprudential science is one of the most important legal sciences for all those who work in the Shari'ah judiciary. This is because they have reached knowledge of the rulings in the manner desired by God. Therefore, the ancient scholars have written these rules with a short jurisprudence that makes it easy for the student to reach them, on her.
The study focused on the jurisprudence of the Jordanian Shari'a courts through its decisions and follow the decisions issued by the Shari'a courts, while extracting them based on the jurisprudential rules, following these rules with illustrative practical examples, and illustrating the work of the Jordanian Shari'a courts and their procedures during the deliberation of these provisions.

This study was conducted in six chapters The first was a preface that included the definition of the terms of study, the importance of jurisprudential rules and their sources, the establishment of Shari'a courts and the levels of Islamic courts, the first jurisprudential rules related to the case, the jurisprudential rules related to the judge.
I ask God success and repayment, and that this work be in the balance of my benefits, a day that does not benefit money or sons, only God came with a healthy heart.

Summary: Defamiliarisation or ostrannenie, the artistic technique of forcing the audience to see common things in an unfamiliar or strange way, in order to enhance perception of the familiar, ihas become one of the central concept of modern artistic practice, ranging over movements including Dada, postmodernism, epic theatre, and science fiction, as well as our response to arts. Coined by the Soviet literary critic Victor Shklovskii in 1917, ostrannenie has come to resonate deeply in film studies, where it entered into dialogue with the French philosopher Derrida's concept of differance, bordering on 'differing' and 'deferring'. This study aims at revealing and analyzing the view of the orientalist Montgomery Watt, regarding the Khārijite sect, the Sunni-Shiite conflict, and his general thought of the Western-Eastern relationship; all of which in the light of authentic Islamic sources.
This study uses inductive, analytical-comparative, and critical approaches.
This thesis consists of an introduction and three chapters: the first chapter conveys the author’s perspective towards the Khārijite sect, its emergence, and its theoretical developments; the second chapter is about the Sunni-Shiite conflict, the historical developments of this conflict, and the triumph of Sunnism; the third chapter consists of the impact of politics on the Sunni-Shiite Conflict and Watt’s general perspective of the Western-Eastern relationship. The author has good points regarding the analysis of the Khārijites’ and the Shiites’ emergence and how their origins affected their beliefs, however, his orientalist perspective towards Arabs and Muslims is clear in his writings as
تهدف هذه الدراسة إلى عرض وتحليل وجهة نظر المستشرق مونتجمري وات ، الملقب بآخر المستشرقين، حول فرقة الخوارج والصراع السني الشيعي ومدى تأثير تطورات الشرق على الغرب والعكس ومقارنة كتاباته مع مصادر التاريخ الإسلامي في ضوء القرآن والسنة النبوية. تتكون هذه الدراسة من مقدمة وثلاثة فصول: تعريف الخوارج والشيعة وفرقها، والسنة، إضافة إلى نبذة عن مونتجمري وات. يتكون الفصل الأول من تعريف المؤلف للخوارج ونشأتهم وتطوراتهم العقدية، ويدور الفصل الثاني حول رأي وات في الصراع السني الشيعي والتطورات التاريخية لهذا الصراع، أما الفصل الثالث فيتكون من وجهة نظر وات للعلاقة بين الشرق والغرب وكيف أثر كل منهما على الآخر. وات عرض نقاط جيدة فيما يتعلق بتحليل ظهور الخوارج والشيعة وكيف أثرت أصولهم على معتقداتهم ، إلا أن نظرته الاستشراقية تجاه العرب والمسلمين بأنهم قدموا من البدو وثاروا ضد حكامهم لعدم تقبلهم الحياة في المدينة، وتكلمه عن الصحابة رضوان الله عليهم بأنهم لم يكونوا خلفاء ناجحين، وأن العرب غير متطورين وسيؤثر عليهم الغرب عاجلا أم آجلا لضمان تقدمهم، كل ذلك وأكثر كان أيضا واضحا في كتاباته.
