نظراً لظهور الثورة الصناعية الحديثة وانتشار التكنولوجيا وتعاظم الإنتاج الكبير والشركات المنتجة على المستويات العالمية والتي تستطيع أن تفرض نفسها على السوق الاستهلاكي بما يمس حرية وارادة المستهلك والذي أصبح طرفا ضعيفا لابد من حمايته من كل ما يمس رضاه وحريته في الاختيار ويوقعه في الغلط والخداع فكان لابد من بيان وسائل الحماية الفردية للمستهلك باعتبار أن أنماط الاستهلاك والمصالح الإنسانية تهم رجال القانون والتشريع.
ولذلك يمكن حماية المستهلك من الناحية المدنية الفردية باللجوء إلى القضاء الذى يمكن له الاستعانة بالقواعد العامة في عيوب الرضا خصوصا التدليس والاستغلال والالتزام بضمان العيوب الخفيفة والالتزام بتقديم المعلومات والتنفيذ العيني والمسؤولية التقصيرية.
بيد أن الحماية التي تقدمها القواعد المدنية المبنية على القواعد العامة التقليدية محدودة الأثر عملا . فانطباق نظرية التدليس وإبطال العقد تبعا لذلك يستلزم أن تكون الحيل التدليسية التي لجأ إليها المعلن قد بلغت حدا من الجسامة، بحيث لولاها لما أبرم المستهلك العقد. وعلى ذلك إذا لم يكن هناك عقد في معنى القانون المدني ،فلا مجال للحديث عن تدليس . وإبطال العقد للتدليس يوفر حماية فردية للمستهلك الفرد ومن ثم فإن مردودها الاجتماعي ضعيف الأثر ، خاصة إذا ما وضع في الاعتبار أن المستهلك الفرد لا يلجأ كثيراً إلى القضاء بسبب الجهل أو تكاليف وطول أمد التقاضي . لذلك لم يعد ممكنا الوقوف عند حد الجزاءات التي توفرها القواعد المدنية كما هو الحال من قبل ، لذلك برزت الحماية الجماعية للمستهلكين من خلال دعأوى النقابات والجمعيات التي تهتم بحماية المستهلكين والتي أصبحت المانع الأول في حماية المستهلك.
وتكتمل الحماية بإصدار التشريعات التي تكفل حماية المستهلك من المنتجات الضارة كالكحوليات والتبغ، وكذلك التي تمس مصالح المجتمع وكيانه كالأدوية، والأطفال والنساء.
والتشريع كأداة لإحداث التوازن بين الإنتاج والاستهلاك وتجنب الجوانب الضارة بالمستهلك، لا يقلل من أهمية العوامل أو الأدوات الأخرى. التي تلعب بدورها دورا مؤثرا في إحداث التوازن المنشود. ومنها الأدوات غير التشريعية كلائحة شرف مهنة المعلنين والاتفاقات الجماعية بين المعلنين - والمستهلكين التي وضعت قواعد منظمة والتي تقوم بدور موازي للحماية التشريعية والقضائية.
